Your privacy matters to us. This policy explains how Anish & Nisarg Realty (“we”, “us”, “our”) collects, uses, discloses and protects personal information when you visit www.anishandnisarg.com or work with us. We handle personal information in accordance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), Canada’s Anti-Spam Legislation (CASL), the Trust in Real Estate Services Act, 2002 (TRESA) and the Code of Ethics of the Real Estate Council of Ontario (RECO), and the privacy obligations of REALTOR® members of the Canadian Real Estate Association (CREA).

1. Who we are

Anish & Nisarg Realty is a team of real estate salespersons (REALTOR®s) registered with RECO and working with Royal LePage Terra Realty, Brokerage, 2345 Argentia Road, Unit 201B, Mississauga, ON L5N 8K4. Our brokerage is independently owned and operated. Personal information collected through this website is used by our team and, where required, by our brokerage, which supervises our real estate activities and keeps transaction records as the law requires.

2. Information we collect

We collect only the information we need to help you. This includes:

Information you give us through our contact, home evaluation, showing request and newsletter forms or our chat assistant: for example your name, email address, phone number, property address, preferred showing times, your message and the topic you chose.
Information needed for a real estate transaction if you become a client: for example details about the property, your buying or selling goals, and identity information we are legally required to verify and record under federal anti-money-laundering rules (FINTRAC).
Information about how you found us: the page you contacted us from, the website that referred you and any campaign tags in the link (for example from an advertisement), recorded with your enquiry.
Your email preferences: whether you agreed to receive market updates, and when.
Technical information that web browsers send automatically, such as your IP address and browser type, which our hosting provider may process briefly to deliver the website and protect it from abuse.

We do not knowingly collect sensitive information such as health or financial account details through this website. Please do not include it in forms or messages.

3. How we use your information

To respond to your questions, call or message you back, arrange showings and prepare home evaluations.
To provide real estate services if you become our client, including preparing agreements and working with other parties to your transaction.
To send you market updates and new listings, only if you have agreed to receive them.
To meet our legal and regulatory obligations, including those under TRESA, RECO’s Code of Ethics and FINTRAC.
To understand which pages and advertising bring enquiries, so we can improve our website and services.
To keep our website secure and prevent spam and misuse.

We do not sell, rent or trade your personal information.

By submitting a form, using the chat assistant or contacting us, you consent to us using your information to respond and for the purposes described in this policy. We ask for separate, express consent before sending you marketing emails. You may withdraw your consent at any time, subject to legal or contractual restrictions, by contacting us. If you withdraw consent, we may not be able to provide some services.

We share personal information only when needed and only with:

Our brokerage, Royal LePage Terra Realty, Brokerage, which supervises our work and keeps transaction records.
Parties to your transaction, with your knowledge: for example co-operating brokerages and their salespersons, lawyers, mortgage brokers and lenders, appraisers, home inspectors and stagers you choose to work with.
Service providers that host our website and database, deliver email and forward our email addresses. They may only use your information to provide their service to us.
Regulators and authorities where required or permitted by law, such as RECO, FINTRAC, courts or law enforcement.

We never share your information with other businesses for their own marketing.

6. MLS® and listing information

If you list your property with us, information about the property (and, where required, the names of sellers on the listing agreement) is shared with the Multiple Listing Service® of the Toronto Regional Real Estate Board (TRREB) and may be published on this website, REALTOR.ca and other websites, as described in your listing agreement. Listing information on this website that comes from other brokerages is provided under the rules of the applicable real estate board and is deemed reliable but not guaranteed.

7. Email and electronic messages (CASL)

We only send commercial electronic messages, such as market updates, with your consent. Every message identifies us and includes a simple way to unsubscribe, and we act on unsubscribe requests within 10 business days. Replies to your own enquiries, and messages about a transaction you are involved in, are not marketing and may be sent without separate consent.

8. Cookies, browser storage and third-party services

We do not use advertising or tracking cookies, and we do not currently use web analytics. Our website uses your browser’s session storage (which is cleared when you close the tab) to remember how you arrived at our site and whether you have already seen the chat greeting. Staff who sign in to manage the website receive a sign-in cookie.

Some features load content from other companies, which may receive your IP address and browser information when they do:

Google Fonts, for the website’s typefaces.
OpenStreetMap, for the maps on listing pages.
Instagram (Meta), for Instagram posts shown on our pages.

Links to Google, WhatsApp, Instagram, Facebook and other websites are governed by those companies’ own privacy policies. If you message us on WhatsApp or social media, those services process your messages under their own terms.

9. Where your information is stored

Enquiries and website data are stored in a database hosted by Microsoft Azure in Canada. Some of our service providers, including our website host and our email and email-forwarding providers, may process information in the United States or other countries. Information processed outside Canada is protected by our agreements with those providers, but may be accessible to courts, law enforcement and national security authorities of those countries.

10. How long we keep it

We keep enquiries and contact details only as long as needed for the purposes described above, or until you ask us to delete them. Records relating to real estate transactions are kept for the periods required by law, including under TRESA and FINTRAC rules, and then securely destroyed.

11. How we protect it

We use reasonable physical, organizational and technical safeguards appropriate to the sensitivity of the information, including encrypted (HTTPS) connections, encrypted storage, and sign-in controls that limit access to our team and authorized brokerage staff. No method of transmission or storage is completely secure, but we work to protect your information and will notify you and the Privacy Commissioner of Canada of any breach that creates a real risk of significant harm, as the law requires.

12. Your rights and choices

You may ask what personal information we hold about you and how it has been used and shared.
You may ask us to correct information that is inaccurate or incomplete.
You may withdraw consent or ask us to delete your information, unless we must keep it by law.
You may unsubscribe from marketing emails at any time using the link in any email, or by contacting us.

We will respond to requests within 30 days. We may need to confirm your identity before releasing information.

13. Children

This website is intended for adults. We do not knowingly collect personal information from anyone under 18.

14. Changes to this policy

We may update this policy from time to time. The latest version is always posted on this page with the date it was last updated.
